What happens if you and your eligible spouse at the retirement date separate or divorce in retirement?
Your eligible spouse at the time of your retirement remains your eligible spouse for survivor benefits unless he or she has formally waived survivor benefits in accordance with the conditions set out in the applicable legislation in your jurisdiction of employment.
Contact the Plan to obtain the applicable spousal waiver form based on your employment jurisdiction. If your eligible spouse at the time of your retirement has waived the survivor's pension as described above and you have a subsequent spouse on the date of your death, that subsequent spouse will then be eligible for the survivor's pension, provided you and that subsequent spouse were living together on the date of your death.
If you separated from your spouse upon retirement or if you have a new spouse, please contact the Plan administration immediately to ensure your file is up to date. The terms "living separate and apart" and "separated" refer to separate living arrangements intended to end the marriage or common-law relationship, and do not refer to a situation where one spouse is in long-term care or is not living in the couple's residence for another reason.
